PASKO NA NAMAN! Longest Christmas Season It's Christmas season once again. Pasko or Christmas is one of the most celebrated events in the Philippines. In fact, we have the longest Christmas season in the whole world. It's known as the "Ber months", with September as the starting month. Section 4 Rule 74 Annotation on Title

What is Section 4 Rule 74 These past days, I was busy working on four Extra Judicial Settlement of Estate processes. Three of which were about Annotation of Extra Judicial Settlement of Estate to claim sum of money, and the other was Extra Judicial Settlement of Estate with Absolute Sale. From these experiences, I was able to understand the logic behind annotation of Section 4 Rule 74 on the title.  As I understand, within the two (2) years after the settlement of estate and its distribution, if there's an heir or a person who will come up to say that he/she is deprived of his/her lawful participation in the estate, then he/she can compel the settlement of the estate in the courts per provision of Section 4 Rule 74, Rules of  Court.  As we can see,  annotation of  Section 4 Rule 74 on the title, when we are processing settlement of estate, is really important.  Anyway, once the two (2) year period has passed and no claimant has showed up,  you can have the annotation of Section 4 R

LRA On-line Tracking System (LOTS)

LRA On-line Tracking System (LOTS) This is a very good project of the LRA. Here, we are able to track the status of our transaction with any branches of the Registry of Deeds through out the country via online. This will eliminate the hassle of calling or going to their office personally to follow up a transaction. We can do the follow up at our own pace because it is through online. This is very favorable to avoid the traffic and transportation expenses when doing personal follow up. WAYS TO SETTLE AN ESTATE

There are three ways to settle an estate here in the Philippines. They are via the Extra Judicial Settlement, the Affidavit of Self-Adjudication, or through the Judicial Settlement of Estate. Extra Judicial Settlement of Estate It is the option to use when the following scenarios are present: 1. There is no last will and testament left by the decedent (owner of the estate who passed away) 2. There are several heirs and they agree to the division agreement. 3. There is  no debt left behind or has been fully paid. For those who want to settle their estate via the Extra Judicial Settlement, please be advised that the ongoing Estate Tax Amnesty will be expiring on June 14, 2023. The amnesty is applicable for those who passed year 2017 below.  It would be a great help because you won't be required to pay interest and surcharges. Contents: Filing TIN of the Estate  Transfer of RDO- BIR form 1905 TIN of the Estate - BIR Form 1904   When we are filing for an Estate Tax, aside from the many requirements that we need to submit, filing a TIN of the Estate is also a must to do. We will be using the TIN of the Estate in paying the Estate tax. It will be applied using BIR form 1904. Filing TIN of the Estate  Lately, we were able to process an Extra Judicial Settlement of Estate. I was one of the Attorneys-in-Fact. The place of residence of the decedent (the one who passed away), was NCR. When we were in the process of applying TIN for the Estate, the BIR staff noted that the TIN of the decedent, when he was still living, was from another BIR RDO branch. The RDO advised that we need first to have the TIN of the decedent cancelled. Today is November 1, 2022, a Tuesday and it's All Saints Day, a day to remember the saints who had lived exemplary life while still here on earth. It is a teaching from our church to celebrate November 1 as a day to remember the saints and November 2 for the souls of people who have already departed. It's important to celebrate these days as a great reminder that once we had these people with us and we shared everything in life with them. To remember them by offering prayers and doing good deeds by imitating the simplicity and goodness of a saint's life when still on earth. That would be a great way to honor them. Deed of Sale of Unsegregated Portion of Land

Contents: The process we did Deed of Sale part of the process: The title process with the Registry of Deeds Magandang araw! Another real estate process I encountered was the sale of unsegregated portion of land. A portion only was bought by the buyer and the owner of the land agreed to the offer of the buyer to buy just a portion of the lot. There was meeting of the minds since both parties agreed, hence the sale transaction was perfected. The process we did: We hired a licensed geodetic engineer to survey, relocate and subdivide the lot. The goal was to cut a portion from the mother titled lot, and there will be two resulting lots, the portion subject of this sale and the remaining lot which will remain under the original owner's name. The fee was per resulting lot, which was P10,000.00 per resulting lot at that time or P20,000.00. That included survey, relocation, subdivision into two resulting lots and approval with the Bureau of Lands, now, Land Management Bureau. At that time

Affidavit of Loss

Magandang araw!  There are times when we lost important things or documents in our everyday life. We may be are too busy and we tend to forget where we put things inside the house or anywhere outside. In this case, for important things or papers, we may need to have an Affidavit of Loss prepared and notarized by a lawyer. This happened to us. We were about to claim the eCAR from BIR on one of the sale processes that I worked on in the past. We were already at the BIR office when we realized the claim stab was missing. The BIR releasing staff told us to submit an affidavit of loss. It was hard looking for a law office near BIR, but was able to find one more or less five kilometers away. That was tough and burdensome.    So as a friendly reminder to everyone, make sure you have your claim stub before proceeding to BIR to claim your eCAR. VOLUNTARY TITLE STANDARDIZATION PROGRAM OF LAND REGISTRATION AUTHORITY (LRA)

What is Voluntary Title Standardization (VTS) Program? This is LRA's project, computerizing titles they have on files. Per LRA, this project will make on-line information on titles current, complete and accurate, security and integrity of records is maintain and timely detection and identification of fake land titles. How to Transfer Shares of Stock to the Heirs

Good morning!❤️ Our topic for today is about transfer of shares of stock to the heirs.  Two weeks ago I was at the BIR presenting for computation of Estate Tax Return an Extra Judicial Settlement of Estate. The BIR examiner noted some shares of stock were included in the document. Our intention was for those shares to be transferred to the heirs just like the real estate properties. For these, BIR examiner advised that we get a certificate from the Philippines Stock Exchage (PSE) that would show the price of the stock as of the date of death of the DECEDENT. That would be presented to the BIR together with the stock certificate. We called up PSE helpdesk and was advised to email PSE for our concern, then from there PSE will act on our request. PROPERTIES NOT INCLUDED IN EXTRA JUDICIAL SETTLEMENT OF ESTATE- WHAT TO DO

I would be sharing again an experience I encountered few days ago with regard to the Extra Judicial Settlement of Estate I am currently working on. First, I will bring you back to November 2021, when I posted the work processes I did for an Extra Judicial Settlement of Estate under TRAIN LAW. Remember also that under TRAIN LAW, the Estate of the Decedent is entitled to a 5Million standard deduction. Then.. the heirs of the Decedent realized there are still real estate properties that they failed to include in that Extra Judicial Settlement of Estate mentioned above.
