You’ve finally gathered the siblings, signed the Extrajudicial Settlement (EJS), and figured out the newspaper publication details. You might think the hardest part is behind you, but there is one massive gatekeeper you still have to pass before the property can officially be transferred to your names: the Bureau of Internal Revenue (BIR) . To change the name on a land title, the Registry of Deeds will strictly demand an eCAR (Electronic Certificate Authorizing Registration) . Affidavit of Loss

Magandang araw!

There are times when we lost important things or documents in our everyday life. We may be are too busy and we tend to forget where we put things inside the house or anywhere outside. In this case, for important things or papers, we may need to have an Affidavit of Loss prepared and notarized by a lawyer.

This happened to us. We were about to claim the eCAR from BIR on one of the sale processes that I worked on in the past. We were already at the BIR office when we realized the claim stab was missing. The BIR releasing staff told us to submit an affidavit of loss. It was hard looking for a law office near BIR, but was able to find one more or less five kilometers away. That was tough and burdensome.

So as a friendly reminder to everyone, make sure you have your claim stub before proceeding to BIR to claim your eCAR. They won't settle for a scanned copy or a photocopy of the claim stub, in case you have them before it got lost. That's exactly what happened in our case. Only an Affidavit of Loss will be accepted by BIR in place of the lost claim stub.

Attaching herewith for your reference the Affidavit of Loss template:

Finally, thank you for having dropped by, hope the information is useful.

GOD BLESS EVERYONE!
