Part 5 - DAR CLEARANCE- Extra Judicial Settlement of Estate

Greetings!

It's been quite sometime since my last update on Part 4 - Extra Judicial Settlement of Estate. This Part 5 is just a continuation.

For your information, this Extra Judicial Settlement was for the estate of an ancestor who passed away in the 1980's, hence it was qualified to avail of the Estate Tax Amnesty which is currently ongoing up to 2023. The estate tax was computed straight 6% of the market value of the property at the time of death, without any penalty. 

The estate tax was paid and all documents submitted to BIR June 2021. The eCAR was released to us end of September 2021. It took the BIR three months to process the ECAR. The pandemic was one great reason for the delay, I supposed.

NEXT STEP- THE REGISTER OF DEEDS

Although I'm not yet ready to submit this to the Register of Deeds,  as this is provincial and far from my location, but I need to gather all the requirements needed for the submission. For this, I was able to research in advance. In fact, I really went to their respective offices to get first hand guidance and information.

Attaching here the list of requirements needed by the Register of Deeds to pass on the ownership to the heirs. The Register of Deeds' branch you will go to,  is the one who has jurisdiction over the property, the one nearest to it.




Then, since the property is agricultural, I need to secure a DAR clearance from the nearest DAR office which has jurisdiction over the property. Further, this DAR clearance has requirements that need to be submitted as well, aside from the fee of P2,000.00. Attaching the following for your reference:








In our case, once I will be able to secure the above,  per DAR's requirements, I already can proceed to the Register of Deeds for the transfer of ownership to the heirs.

Please check with the properties' nearest DAR office, as they may have updated their forms for the APPLICATION FOR DAR CLEARANCE and SINUMPAANG SALAYSAY.

UPDATE JUNE 16, 2022

Our DAR clearance request has been submitted. We submitted our request April 18, 2022, but was not accepted because they have updated their forms. We were given the updated forms which I shared with you all to spare everyone with hassles in case you are also processing this one. Just imagine the distance to travel, as this is outside Manila and the expenses in re doing things, notarization and others, it's not easy. 

Fortunately, after some questions and answer with a DAR officer 2 days ago, I think everything is clearer now. So, I am hoping and praying I would be able to get the clearance soon.  Pray for us, we need it badly🙏❤️

August 31, 2022 FINAL UPDATE:

Finally, August 2, I was advised that the DAR certifications were available, thank you so much! After 3 months, this was completed.
But due to some issues, (my athritis), I was not able to get it, until I requested my nephew to pick it up and send to me via LBC.

I just can't show the certificates here because they are customized according to our particular concern. It was not a clearance, but just certifications to allow us to move on to the Registry of Deeds for the annotation of the Extra Judicial Settlement of Estate.

I will close this here, will just create another blog when I will start working with the Registry of Deeds.
